Any telemedicine consultation services accessed through the Website are provided by independent RMPs made available through a third-party telemedicine service provider, Mswasth (“Telemedicine Provider”). These RMPs are not employees, agents, representatives, or partners of the Company. The Company merely facilitates access to such services through its technology platform.

The Company explicitly states that it does not provide medical advice, diagnosis, treatment, or telemedical consultation services to Users. All medical consultations are provided solely by the RMPs through the Telemedicine Provider with the User’s express or implied consent.

You acknowledge that the content, text, data, graphics, images, information, suggestions, blogs, guidance, and other materials made available on the Website are provided for general informational purposes only and do not constitute medical advice. Such information should not be relied upon as a substitute for professional medical advice, diagnosis, or treatment from a qualified medical practitioner, except for advice obtained directly from Your Doctor during a consultation.

You agree and acknowledge that the RMPs made available through the Telemedicine Provider are independent professionals, and any consultation or medical advice provided by them shall constitute a doctor-patient relationship solely between You and the relevant RMP. The Company does not control, supervise, or influence the medical judgment of the RMPs.

Accordingly, the Company shall not be liable, whether directly or vicariously, for any medical advice, diagnosis, prescription, treatment, or other healthcare services provided by the RMPs. In the event of any alleged malpractice, negligence, or regulatory non-compliance by an RMP, You agree to notify the Company promptly so that the Company may raise the issue with the Telemedicine Provider. However, the Company shall not be responsible for adjudicating or resolving any such dispute between You and the RMP.

The Telemedicine Provider, Mswasth, and the RMPs shall be solely responsible for ensuring compliance with all applicable telemedicine and medical practice laws, including the Telemedicine Practice Guidelines 2020 issued under the regulatory framework of the National Medical Commission. The Company does not independently verify medical registrations, professional credentials, or clinical practices of the RMPs.

The telemedicine services facilitated through the Website are not intended for medical emergencies or critical health situations. In the event of a medical emergency, You must immediately contact local emergency services or visit the nearest hospital or healthcare provider.

The telemedicine services rely on telecommunications networks and internet connectivity. The Company does not guarantee that the services will be uninterrupted, timely, secure, or error-free. The Company shall not be liable for misdiagnoses, consultation delays, or any adverse outcomes arising from technical failures, internet disruptions, or platform downtime.

Where Users access telemedicine consultations while travelling outside their country of residence, the availability and legality of such consultations may vary depending on the applicable laws of the jurisdiction from which the services are accessed. The Telemedicine Provider or the RMPs may decline to provide consultations where regulatory restrictions apply.

You are responsible for ensuring that any information, including medical history or personal data submitted by You, is accurate and complete. The Company shall not be responsible for validating such information.

By using the telemedicine facilitation services, You consent to the collection, storage, and sharing of Your health information, medical records, and consultation details with the Telemedicine Provider and the RMPs strictly in accordance with the Platform’s Privacy Policy and applicable laws, including the Digital Personal Data Protection Act, 2023. The Company acts solely as a technology intermediary facilitating the transmission of such information and shall not be responsible for the independent data processing practices of the Telemedicine Provider or the RMPs.
